ProService Finteco Sp. z o. o., by the decision of the Polish Financial Supervision Authority (PFSA) (DFII/I/4031/100/20/16/17/U/AS) from 29th of May 2017, distributes open investment funds and specialized open investment funds units  and also shares of sub-funds.  Within the structure of ProService Finteco Sp. z o. o.  was separated Customer Service Point, which handles Investors by Internet,  phone, IVR System,  fax and directly.

Services provided by ProService Finteco Sp. z o.o. in terms of distribution of unit shares of open investment funds and specialist open investment funds:
1. Placing Investors’ orders and instructions via phone, fax, IVR system and in the correspondence form;
2. Placing Investors’ orders and instructions directly at the Customer Service Point of ProService Finteco Sp. z o.o.;
3. Control of orders and instructions placed in the internet platform;
4. Reporting of orders and instructions placed to Transfer Agent;
5. Providing Investors and potential Investors with information about the principles of participation in Investment Funds and register balance by phone or directly at the ProService Finteco Sp. z o.o. Customer Service Point.

Procedures used by ProService Finteco Sp. z o.o. employees while placing orders by phone, fax or directly:
1. ProService Finteco Sp. z o.o. does not provide clients with cash service. ProService Finteco Sp. z o.o. employee can not take cash.
2. ProService Finteco Sp. z o.o. does not provide investment advice.
3. ProService Finteco Sp. z o.o. (CSP) employees while placing orders from Investors can not imply in any way the Investor to choose a given Company/Fund, whose units are distributed by ProService Finteco Sp. z o.o..
Investor shall take his own decision about the Company and the fund/ funds as well as about orders placed. The ProService Finteco Sp. z o.o. employee, upon client’s request, is obliged to inform him about the principles of investing in the funds, investment risk and cost, make sure that the knowledge held by the Investor about investment principles allows him for conscious submission of order.

The Investor has the possibility to obtain information about the rules for participation in Funds/Sub-funds by:

1. Phone contact with ProService Finteco Sp. z o.o.. The ProService Finteco Sp. z o.o. employee will provide Investor with all information about the rules of participation in funds/sub-funds, fees, the terms of reduction and lowering of subscription fees, the rules for granting and revoking Powers of Attorney (in the field specified by the funds/sub-funds in the advertising materials and information received from the Investment Company).

The complaint should specify:
a. details regarding the complained order or instruction (type, date of placing, Fund; Sub-fund, the value of the order);
b. Investor personal data (the owner of the register);
c. personal data of the person placing the order;
d. subject of complaint.

  • The term of handling complaint depends on the specified Investment Company’s procedures.
  • In case of exceeding the deadline of the investigated complaint, a written information is sent to the Investor, specifying reasons of the delay, circumstances to be determined and the estimated time of preparing the reply.
  • The reply to the Investor’s complaint shall be prepared in writing or in a different form agreed with the Investor.
  • Complaints are passed to the competent organizational unit of the Transfer Agent, which examines them according to specified procedures.
  • ProService Finteco Sp. z o.o. as a financial institution undergoes the supervision of the Financial Security Authority.


Managing of the conflict of interests

ProService Finteco Sp. z o.o. drew up the internal regulations, the purpose of which is to prevent conflict of interests and to protect of the company’s confidential information. Details of the subject’s conduct in the event of a conflict of interest may be provided to the client as he request.

Conflict of Interest – circumstances that could lead to a conflict between the interest of ProService Finteco Sp.  z o. o. Associated Person, including between managerial staff, employees and agents or any person directly or indirectly related to the control relationship, and its Clients or between Clients and the obligation of ProService Finteco Sp. z o.o. In a fair manner, taking into account the best interests of the client as well as circumstances that may lead to a conflict between the interests of clients ProService Finteco Sp. z o.o, including conflicts of interest caused by receiving incentives from third parties or remuneration.

Associated Person – a member of statutory bodies ProService Finteco Sp. z o.o., the person remaining with ProService Finteco Sp. z  o.o. in the employment relationship, order or other legal relationship of similar nature, entities belonging to the same capital group as ProService Finteco Sp. z  o.o.

In order to implement the solution aimed at identification of the real Conflict of Interests, their management and control, ProService Finteco Sp. z o.o. has identified potential Conflict of Interests that can appear in relation to its activity.

The identified areas of conflict of interests (list not complete):

  • ProService Finteco Sp. z o.o. or ProService Finteco Sp. z o.o. employee has an objective reason or the financial one to prefer the client to another one;
  • ProService Finteco Sp. z o.o. or ProService Finteco Sp. z o.o. employee will receive a financial profit other than the standard payment from a person other than the client in connection with the service provided to the client;
  • ProService Finteco Sp. z o.o. or ProService Finetco Sp. z o.o. employee can benefit or avoid a loss as a result of suffering a loss or not bringing a profit by the client;
  • ProService Finteco Sp. z o.o. or ProService Finetco Sp. z o.o. employee has a business in a specified result of the service provided to the client and it may be diverged from the client’s interest;
  • ProService Finetco Sp. z o.o. or ProService Finteco Sp. z o.o. employee runs the same business as the client or ProService Finteco Sp. z o.o. employee runs the same business as ProService Finteco Sp. z o.o.;
  • ProService Finteco Sp. z o.o. or ProService Finteco Sp. z o.o. employee uses information concerning one of the clients to benefit or to avoid loss to the other client;
  • ProService Finteco Sp. z o.o. or the ProService Finteco Sp. z o.o. employee uses confidential information in order to benefit or to avoid loss.

Accepted methods of the management of conflict of interests
ProService Finteco Sp. z o.o. controls taking any other paid/social activities by ProService Finteco Sp. z o.o. employee and accepting gifts / benefits in the material or immaterial form as well as employees investments.

ProService Finteco Sp. z o.o. divided the role of the Customer Service Point is the scope of its agent activities regarding sale and redeem of fund shares from the units responsible for the Transfer Agent activities.

ProService Finteco Sp. z o.o. assured, that the client makes decisions regarding the choice of the given Company, fund/funds or placing order or instruction single-handedly.

The obligation to keep confidentiality of information
Each ProService Finteco Sp. z o.o. employee is obliged to preserve in secret confidential information, not to disclose and not to use the information obtained during his cooperation with ProService Finteco Sp. z o.o. for purposes other than the proper execution of duties. The obligation referred to the above applies to all confidential information acquired in the course of cooperation with ProService Finteco Sp. z o.o..
The obligation mentioned above involves employees for an indefinite period after standing still of the employment between the ProService Finteco Sp. z o.o. employee and ProService Finteco Sp. z o.o.. ProService Finteco Sp. z o.o. has implemented technical and organizational solutions which aim is to limit access to information only to persons eligible for this.

Cost and Commission
ProService Finteco Sp. z o.o. acting upon the Polish Financial Supervision Authority (PFSA) decision does not collect fees for services from the fund investment clients.

The only fees collected are available in the fee table available on the Investment Company’s web page.
